AUCTION TERMS

330 Julia Street Unit C-1A

 

Written bids with deposits are due Sept. 21

 

a.   To become a Qualified Bidder, a bidder must no later than 5:00 P.M. CDT September   21, 2015 (“Bid Deadline”) (i) submit a Written Opening Bid to Sperry Van Ness/Gilmore Auction, Attn. David Gilmore, 3316 Florida Ave., Kenner, LA 70065, 504-468-6800, david.gilmore@svn.com in an amount of no less than $695,000 (ii) submit a form of financial ability to close on the Property within the time frame set forth herein as may be acceptable to the Debtor, and (iii)   pay a $10,000 Deposit by cashier’s check or wire transfer, to SVN Gilmore Auction, as Escrow Agent for the Debtor (for Wire Transfer Instructions, contact SVN Gilmore Auction, David E. Gilmore, 504-468-6800).

 

b.  Qualified Bidders must also complete their due diligence investigations no later than        the Bid Deadline.

 

LIVE AUCTION SEPT. 25 (BIDDERS MUST SUBMIT A WRITTEN BID IN ORDER TO PARTICIPATE IN THE LIVE AUCTION)

 

c.   The auction will take place in the courtroom at the United States Bankruptcy Court for the Eastern District of Louisiana, 500 Poydras Street, Rm. B-709, New Orleans, Louisiana on the earliest available date that is at least two business days after the Bid Deadline.    The  Court  will conduct  a  hearing  immediately  following  the  auction  to confirm the highest and best bidder (the “Successful Bidder”) and to enter an order confirming the sale to the Successful Bidder (the “Sale Order”) and may also identify one or more Back-Up Bidders.   The Successful Bidder must submit a 10% non-refundable Deposit immediately upon conclusion of the auction.

 

d.  A buyer’s premium of ten percent (10%) will be added to the final winning bid and included in the total contract price paid for the Property (“Buyer’s Premium”).

 

e.   In the event a Successful Bidder does not close on the sale within twenty-one (21) days after the entry of the Sale Order, the Deposit will be retained by the Debtor as liquidated damages, and the Property will be sold to a Backup Bidder, in the order of the priority of the Backup Bidders, as determined by the Court.

 

f.   The  property  will be  offered  in  “as  is”  condition,  without  warranty  as  to  property condition or title.
